Duration of maintenance

The statutory maximum duration of the obligation to pay spousal maintenance.

The duration of maintenance determines how long spousal maintenance must be paid. Since the Maintenance Amendment Act (2020), the main rule is a maximum period of five years, with exceptions for long-term marriages (longer than 15 years) and families with young children. For marriages longer than 15 years, a maximum period of 10 years applies.

Because the marriage had lasted 18 years, a maximum maintenance period of ten years applied.
