Need (behoefte)
Need is the amount a person requires to support themselves and is the starting point for the level of maintenance.
Need ("behoefte") determines how much maintenance a person requires. It is the mirror image of the payer's financial capacity.
For spousal maintenance, need is often calculated using the court norm: 60% of net household income during the marriage, minus own income. The benchmark is the standard of living the parties were used to during the marriage.
For child maintenance, need is based on the NIBUD tables, using household income and the number of children.
The ex-partner must substantiate their need as far as possible with a needs list. There is also an obligation to make efforts to provide for one's own livelihood.
