Need and financial capacity
The two pillars for calculating alimony: what does the recipient need and what can the payer afford?
When determining alimony, two factors play a role: the need of the recipient (what do they need to provide for their livelihood) and the financial capacity of the payer (what can they pay after deducting their own necessary expenses). The need is often determined based on the standard of living during the marriage. The financial capacity is calculated based on income minus necessary expenses.
“The judge assesses both the needs of the ex-partner and the financial capacity of the alimony payer.”
