The division of joint assets and property after divorce.
Division of assets is the distribution of joint property after a divorce. In a marriage under community of property, the entire estate is in principle divided equally. This includes the house, savings, investments, cars, but also debts. With a prenuptial agreement, the division depends on what was agreed. The reference date for the size of the estate is in principle the moment the divorce petition is filed.
