Unilateral petition
A divorce petition filed by only one spouse at the court.
A unilateral divorce petition is filed when only one spouse wants the divorce, or when the parties cannot agree on the terms. The petitioning party submits a petition to the court through a lawyer. The other spouse (respondent) receives the petition and may file a defence, possibly with an independent counter-petition. The procedure usually takes longer than a joint petition.
“Because they could not agree on alimony, she filed a unilateral divorce petition.”
