Occupancy compensation
Compensation paid by the ex-partner living in the home to the other for its use.
An occupancy compensation is a reasonable fee that one ex-partner pays to the other for the exclusive use of the joint home after separation but before division. If one ex-partner continues to live in the home while the other has left, the departed partner may claim compensation. The court determines the amount based on reasonableness and fairness, often based on the equity or rental value of the home.
