Community of property

The legal system where all assets and debts of the spouses are joint.

Community of property is the legal matrimonial property regime in the Netherlands. Since January 1, 2018, a limited community of property applies: only assets acquired during the marriage fall within the community. Pre-marital assets, inheritances and gifts remain private, unless agreed otherwise. Before 2018, a universal community applied where everything was joint. Upon divorce, the community is divided equally.

Because they married under community of property, the house must be divided equally.
