Prenuptial agreement
A notarial deed in which spouses make different arrangements about their assets.
A prenuptial agreement contains arrangements that spouses record in a notarial deed about their property relations. This allows them to deviate from the statutory community of property. Common arrangements include complete separation (everything separate), periodic settlement clauses, or a limited community. Prenuptial agreements can be drawn up before or during the marriage. Upon divorce, the agreement determines how assets are divided.
