Limitering van partneralimentatie
Limiting spousal maintenance
Limiting means capping the duration of, or ending, spousal maintenance by court ruling or by agreement.
Limiting means that spousal maintenance is restricted in duration or definitively ends at a certain point.
Since the Spousal Maintenance Reform Act (2020), the statutory maximum term is in principle half the duration of the marriage, capped at five years. Exceptions apply, including for long marriages and care for young children.
Good arrangements beforehand prevent lengthy proceedings afterwards.
“The court rejected a request to limit maintenance because termination would be too drastic for the recipient.”
