A situation where the same divorce case is already pending before a court in another country.

Lis pendens means that the same divorce case between the same parties is already pending before a court in another country. The court that received the dispute later must then stay the proceedings until the jurisdiction of the court first seized is established.

Due to lis pendens, the Dutch court had to stay the case until the Polish court had declared itself competent.
