Nil assessment
The court setting the alimony obligation to zero due to insufficient capacity to pay.
Nil assessment means that the court sets the alimony obligation to zero. This occurs when the person liable for alimony has insufficient capacity to pay. The alimony obligation still exists, but the amount payable is nil. If circumstances change, the alimony may later be set at a higher amount. Nil assessment can occur for both spousal and child maintenance.
