Reference date

The point in time that determines the scope and value of the assets to be divided.

The reference date determines at what point the composition and/or value of the assets to be divided is established. For the composition of the estate, the reference date is usually the moment of filing the divorce petition. For the valuation of the estate, the date of actual division applies in principle, unless the parties agree otherwise. The reference date is of great importance as value fluctuations (e.g. of the home) can significantly affect the outcome.
