Pension equalization

The division of accrued pension rights between ex-spouses after divorce.

Pension equalization is the division of pension rights accrued during the marriage upon divorce. Under the Pension Rights Equalization Act, the ex-partner is entitled to half of the pension accrued during the marriage. This applies automatically unless otherwise agreed in a prenuptial agreement or divorce settlement. The pension fund must be notified within two years of the divorce.
