Privacy clause
A clause in prenuptial agreements or a will/gift that determines certain assets remain outside the marital property.
A privacy clause (also: exclusion clause) is a provision in prenuptial agreements or a will/gift that determines that certain assets belong to the private property of one spouse and do not fall into joint marital property. The exclusion clause for inheritance or gift is regulated in Article 1:94 paragraph 2 sub a of the Dutch Civil Code.
