Right to compensation

The right to compensation when private property is used for joint property or vice versa.

A right to compensation arises when private property of a spouse is used for the joint property or the private property of the other spouse (Article 1:87 of the Dutch Civil Code). Since 2012, the investment theory applies: the compensation follows the value development of the financed asset, unless otherwise agreed.

She had a right to compensation because her inheritance was used for the renovation of the joint home.
