Relocation with children

The right to move with children after divorce, often requiring consent of the other parent.

In case of joint custody, a parent cannot move with the child without consent of the other parent if this affects the care arrangement. Under Article 1:253a of the Dutch Civil Code, the court can decide on this. The court weighs the interests of the child, the necessity of the move, the interests of the other parent and the feasibility of alternative care arrangements.
