Non-payment of maintenance

The failure to pay or incompletely pay maintenance by the obligated party.

Non-payment of maintenance means that the person obliged to pay maintenance does not pay it or does not pay it in full. The person entitled to maintenance may then contact the LBIO or a bailiff to take collection measures. Additionally, wages, benefits or bank accounts may be seized. In case of continued non-payment, imprisonment may be sought (Article 585 of the Dutch Code of Civil Procedure).

After three months of non-payment, she contacted the LBIO to collect the maintenance.
